Utah Sex Offender Registration and Public Notification
Those convicted of certain sex offenses in Utah must comply with a registration and notification system designed to inform the public and protect against sex crimes.
January 06, 2012 /Law and Legal PR News/ -- Utah Sex Offender Registration and Public Notification
For a Salt Lake City man arrested on suspicion of exposing himself to a family on their way to church, criminal charges could be just the beginning. If the man is found guilty of lewdness toward the woman and two children, Utah law will deal him additional consequences since he is a registered sex offender.
According to Utah's sex offender registry, the man was convicted of sexual abuse of a child in 2000. In 2010, he pled guilty to a charge of lewdness, a felony due to his status as a registered offender, according to the Deseret News. He received a one year sentence.
Information Required of Sex Offenders
Under federal legislation signed into law in the mid-1990s, including Megan's Law and the Jacob Wetterling Act, states must maintain sex offender registration and public notification systems. According to the KlaasKids Foundation, created to stop crimes against children, those convicted of certain sex crimes in Utah must disclose the following information to the Department of Corrections:
-Names & aliases
-Primary and secondary addresses
-Physical description
-Vehicles the offender owns or regularly drives, including make, model, color, year, plate number and VIN number
-Current photograph
-Set of fingerprints
-DNA specimen
-Telephone numbers whether hard line or cell
-Internet identifiers, including website name and address (includes P2P and gaming platforms)
-Copy of passport
-Any documents which establish the offender's immigration status
-Professional licenses authorizing an offender to engage in an occupation or carry out a trade or business, including numbers
-Educational institution affiliation
-Name and address of any place where the offender is or will be employed
-Name and address of any place where the offender works or will work as a volunteer
-Social Security number
Failing to register, provide necessary information or update this information can lead to criminal charges and severe consequences. According to the Foundation, non-compliance in Utah can result in either a felony or misdemeanor.
Defendants charged with sex offenses subject to registration or public notification requirements should consider contacting an experienced sex crimes lawyer who can raise any legal defenses available to you. A skilled criminal defense attorney can investigate your case thoroughly to determine whether it is possible to have your charges reduced or dismissed.
