How Arizona Courts Determine Child Custody and Visitation Rights

Going through divorce can be difficult and emotionally draining, and it can be even harder when it includes a child and child-custody disputes.

The happiest day for a lot of Americans is either their wedding day or the birth of their first child. One of the most difficult, however, is when a couple chooses to go their separate ways after realizing their marriage was not meant to be.

Couples do not envision getting a divorce when they first marry, move into their own place or have a child together. However, according to the Arizona Department of Health Services, Arizona residents have filed for over 22,000 divorces every year for the last decade -- 11th most in the United States -- with each divorce presenting its own unique challenges.

How a Court Determines Custody of a Child

Many parents face the challenge of determining the best post-divorce living situation for their child. Parents might agree to split custody -- a plan generally approved by the court -- but often a mother or father will petition the court for sole custody of a child.

The court intervenes when parents cannot agree and determines what custody plan it believes will serve the best interests of a child. A court will look at several factors to determine what arrangement best meets this standard, including:
-The mental and physical health of a child and his or her parents
-The parent's ability to provide a child with necessities such as shelter, food, clothing and medical care
-The impact on a child's education and his or her social development
-The interaction history and emotional attachment between parent and child
-The child's preference (if above a certain age)

Courts will also look at the particular circumstances of each case in addition to the above factors. Every custodyhearing is different because each family is different, so courts recognize they must take all relevant factors into account.
