EB-5 Investor Visa Becomes More Attractive Option in Recession

"Immigrant Investor" visas (EB-5 visas) are an attractive option for foreign investors and American workers alike.

December 11, 2011 /Law and Legal PR News/ -- The EB-5 Visa program, also known as the "Immigrant Investor Visa" is an investment-based immigration program that grants foreign nationals entry into the United States if they agree to invest a certain amount in a United States commercial enterprise and create a certain number of jobs for American workers. This option is becoming more attractive as the so-called "Great Recession" lingers on because American workers desperately need the jobs, and the obvious benefit for the foreigner -- entrance to the U.S. -- is oftentimes quicker through this program than other visa options.

How Does The Immigrant Investor Program Work?

The "million dollar" visa is so named because essentially, an immigrant investor can apply for permanent resident status under the EB-5 visa program by investing at least one million dollars in an American commercial enterprise that creates at least ten jobs for U.S. workers. Those ten jobs must be independent of the investor him or herself as well as the spouse and children of the named investor. The money must also be legitimately earned and not be the product of any illegal, illicit or corrupt activities in the investor's home country.

Clearly, the EB-5 visa program is aimed at wealthier immigrants who can contribute to the American economy by creating jobs. They don't all have to be millionaires, though. There is another option under the EB-5 program that allows for an investment of only $500,000 in a designated Regional Center (a list of which is maintained by the U.S. Citizenship and Immigration Service) or rural area where the unemployment rate is particularly high.

Although there are many opportunities open for EB-5 investors annually, the process can seem complex to a layperson. If you or a loved one is interested in the immigrant investor visa program, speak with an experienced immigration law attorney in your area to learn more about your legal options.
