Consequences of Fake IDs and Underage Drinking
New Jersey law is tough on fake ID users and underage drinkers. Learn more from the Law Offices of John W. Tumelty.
October 16, 2011 /Law and Legal PR News/ -- Many teenagers find the allure of drinking alcohol almost impossible to ignore. Alcohol advertisements promise a good time with people with good looks. Drinking alcohol is a way to fit in, or a way to "break the rules."
For teenagers who find it difficult to wait to become full-fledged adults in the eyes of the law, a fake ID is the vehicle to the lifestyles portrayed in alcohol advertisements. Teenagers who purchase fake IDs and participate in underage drinking are usually good kids from good families. They make a few poor decisions that lead to arrest.
The consequences of buying and using a fake ID are tough, however, and lawmakers are attempting to crack down on fake ID suppliers. If your child is facing criminal charges for underage drinking and/or possession of a fake ID, Atlantic City underage DWI defense lawyer John Tumelty urges you to take action immediately to protect his or her future.
The state of New Jersey takes fake IDs seriously. New Jersey driver's licenses are some of the most forged IDs in the country since they have relatively simple security measures and easily-duplicated fonts. Compound this with the lure of flashy bars and casinos on the Jersey Shore and one has a recipe for rampant underage drinking in New Jersey. The state, thus, has tough consequences for possessing and using a fake ID. It is a third degree crime to purchase, use or create fake identification in the Garden State. This means that underage individuals caught with fake IDs can face fines up to $1000 and up to four years in prison.
New Jersey Underage Drinking and Driving
The tough consequences of fake ID use are in line with the harsh stance New Jersey takes on underage drunk driving. If someone under 21 is caught drinking and driving, he or she faces a fine of $500 and loss of license from 30 days to one year, depending on the blood alcohol level. Penalties get more severe for the second and subsequent offenses. Courts may also require those convicted of New Jersey underage drunk driving to take an alcohol education program, enroll in an alcohol treatment program and/or perform community service.
Fake IDs From International Sources
A U.S. Senator from New York is calling on the federal government to take action against international firms shipping fake IDs to America's kids. Senator Charles Schumer wants the Department of Homeland Security to identify the specific sources of these fake IDs, which are already known to come from China, and shut them down.
These fake IDs are almost impossible to spot because they often sport watermarks, holograms and magnetic strips common on real IDs. The fake IDs are only discernable using expensive scanners that most bars cannot afford.
If the federal government takes action on Senator Schumer's request, one major source of fake IDs will be shut down, which will hopefully decrease the amount of realistic fake IDs out in the public today.
It is important that parents work to educate their children on the dangers of underage drinking and to take action if they discover that their children have fake IDs. Similarly, if your child has been accused of underage drinking, underage drunk driving, or purchasing, using or creating a fake ID, protect him or her by turning to an experienced New Jersey criminal defense lawyer.
